    PORTLAND, Ore. (AP) — A federal judge was expected to make Oregon the latest state to allow gay marriage Monday after state officials refused to defend its constitutional ban in court.

    Gay couples were poised to tie the knot immediately after a federal appeals court denied a last-minute request to block the judge's impending ruling that could strike down the state's same-sex marriage ban.

    Officials in Oregon's largest county, Multnomah, said they'll begin issuing marriage licenses immediately if U.S. District Judge Michael McShane's decision allows it. McShane hasn't signaled how he'll rule, but both sides in the case have asked that the voter-approved ban be found unconstitutional.

    The judge last week denied a request by the National Organization for Marriage to defend the law on behalf of its Oregon members. On Monday morning, the group appealed that denial to the 9th U.S. Circuit Court of Appeals, seeking an emergency stay of the decision.

    But the appellate court quickly denied the group's request, clearing the way for same-sex marriages to begin immediately if a McShane's ruling allows it.
    In Portland, couples lined up outside the county clerk's office in anticipation of a favorable decision.

    Pick and choose, how about Individuals choose to disregard whatever "laws" that have no victim and don't infringe on others that they feel are wrong?????

    PORTLAND -- U.S. District Judge Michael McShane has ruled that the voter-approved ban on gay marriage was unconstitutional.

    The state attorney general had refused to defend the ban in lawsuits brought by four same-sex couples.

    "Today Judge McShane did the right thing for families, affirming that the denial of marriage to committed same-sex couples in Oregon is unconstitutional. In recognition of the strong support for marriage among Oregonians, no one with legal standing, including our state Attorney General, wanted to go down in history as defending discrimination," said Thalia Zepatos, director of public engagement at Freedom to Marry.

    Officials in Oregon's largest county, Multnomah, said they will begin issuing marriage licenses immediately, unless the judge puts a stay on his own decision.

    Late Monday morning, an appeals court denied a request for an emergency stay that could have blocked McShane's ruling.

    Well if it is the law it must be followed right.

    Read the first sentance, it says it all.
    A federal judge (not able to make law) makes a law that the Constitutional ban is disallowed.

    A federal judge cannot, by my interpretation of constitutional law, make any constitutional laws illegal.
    Maybe I missed something. Or maybe its finally time to begin the purge.

    The good new is the enemy has clearly defined who they are.
    Should make cleaning up this mess somewhat easier.
    Europe used to have empires. They were run by emperors.
    Then we had kingdoms. They were run by kings.
    Now we have countries...

    OR State Const. has no Ban on Homo marriage
    The rulling is a simply a statement to mollify 'gays' in OR and secure their vote, it has no power of law
    it is all "Fabulous' political theater ty secure a Progressive Commie victory in OR

    In a state where the governor and attorney general have said that the Oregonian business owner has no right to freedom of religion, speech, or conscious when the law is concerned, both the governor and the attorney general have declared that they alone have the right to not do what is required to them by law. Not only that, but that us Oregonians are merely Serfs, and we have no standing to put up a defense to the law that we passed.

    Oregon is dead! My family was present when this state was founded and I am here now when it was dissolved. I'm not being melodramatic. We no longer have a Republican form of government in Oregon. We are now running under some form of oligarchy dictatorship. Our votes are worthless, even after they dilute them with an untold number of illegally cast votes. Whatever we vote for will be illegally and Unconstitutionally ignored or over tuned.

    Goodbye Oregon, I will miss you.

    I believe that it actually does. In 2004, Measure 36 was passed. According to the explanatory statement in the voter's guide at the time:

    Ballot Measure 36 amends the Oregon Constitution to declare that the policy of the State of Oregon and its political subdivisions is that "only a marriage between one man and one woman shall be valid or legally recognized as a marriage."

    Under state statutes, a marriage is a civil contract entered into by a male and a female who solemnize the marriage by declaring "that they take each other to be husband and wife." There is ongoing litigation concerning whether the current marriage statutes are valid under the Oregon Constitution. Ballot Measure 36 adds to the Oregon Constitution a statement of policy that only a marriage between one man and one woman is valid or legally recognized as a marriage.
